1. Agreement to these terms
These Terms of Service govern your access to and use of viewtickermatesm.yachts, including the volleyball serve simulator, the 10-serve challenge and all educational content (together, the "Service"). The Service is provided by Viewtickermatesm Ltd, company number 14829736, registered at Unit 4, Harbour Quay Studios, 22 Marina Walk, Southampton SO14 3JF, United Kingdom ("we", "us"). By using the Service you agree to these terms. If you do not agree, please do not use the Service.
2. Nature of the Service
The Service is an interactive simulation and educational resource. Its physics engine uses simplified models of gravity, drag and Magnus lift with fixed parameters. Outputs such as speed, clearance and landing position are illustrative and are not measurements of real-world athletic performance. The Service is not a substitute for qualified coaching, medical advice or professional training supervision.
3. User obligations
When using the Service you agree to:
- use it only for lawful, personal, non-commercial purposes unless we have agreed otherwise in writing;
- not attempt to disrupt, overload, reverse engineer for malicious purposes or gain unauthorised access to the Service or its hosting infrastructure;
- not use automated tools to scrape content at a volume that impairs the Service for others;
- provide accurate information when contacting us and not submit unlawful, abusive or infringing material;
- take responsibility for any physical training you undertake based on our educational content, including warming up appropriately and training within your ability.
4. Intellectual property
All content on the Service — including text, formulas as presented, graphics, the Sunset Court visual design, source code, the simulator and the Viewtickermatesm name and logo — is owned by or licensed to Viewtickermatesm Ltd and protected by copyright, trade mark and other intellectual property laws. You may view and share links to the Service and quote short excerpts with attribution for non-commercial educational purposes. Any other reproduction, distribution or modification requires our prior written consent. Underlying physical laws and standard regulation court dimensions are not claimed as our property.
5. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend or discontinue any part of it, including scoring rules and engine parameters, at any time. Locally stored scores may become incompatible after updates.
6. Disclaimer
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement.
7. Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed £100. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited under applicable law. If you are a consumer, your statutory rights are unaffected.
8. Termination
We may suspend or terminate your access to the Service at any time, without notice, if you breach these terms or use the Service in a way that could cause harm to us, other users or third parties. You may stop using the Service at any time and may clear any locally stored data through your browser. Sections 4, 6, 7, 9 and 10 survive termination.
9. Governing law
These terms and any dispute or claim arising from them or their subject matter, including non-contractual disputes, are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom or in the European Union, you also benefit from any mandatory protections of the law of your country of residence.
10. Disputes
If you have a concern, please contact us first at [email protected]; we will try to resolve it informally within 30 days. If a dispute cannot be resolved informally, the courts of England and Wales shall have jurisdiction, except that consumers may also bring proceedings in the courts of their country of residence.
11. General
If any provision of these terms is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce a right is not a waiver of it. These terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and us regarding the Service. We may update these terms from time to time; the date above shows the latest revision.
